Ethics and Responsibility of Customers – Damages/Compensation

Product Description
Jskare tries to be as accurate as possible regarding the characteristics of the products displayed in the Website.
However, Jskare is not responsible in the event that the features or other content related to products sold through the Website are inaccurate, incomplete, not up-to-date, or in general with errors, which cannot be foreseen or have arise unintentionally or due to technical issues of this Website or its servers, or for reasons of force majeure. In particular, Jskare is not responsible for defective products and/or untrue information regarding the goods of its suppliers and contained on this Website. The relevant responsibility falls exclusively on its individual suppliers.
Order
The Customer can order the products available for sale that are presented on the Website, in accordance with the conditions and the prescribed ordering procedure.
Jskare is against collecting data and making orders from minors, those who are under 18 years old.
For a Customer to place an order, he must: (a) fill in the relevant form with the necessary information required to conclude the sales contract, (b) unconditionally accept the terms of the sales contract, regarding the item being sold, the quantity, the price including taxes and other costs, the way of processing the transaction, the time and place of delivery of the product through a courier company, (c) to unconditionally accept the present terms of use, which are an integral part of the contract being drawn up.
By sending the order form, the Customer receives online an electronic copy of the order, which he can save, and which includes the above information and also specifies the method of payment and the terms.
Prices
All prices quoted are in Ringgit Malaysia. You shall be charged according to the prices stated in this website and such other miscellaneous charges such as delivery charges, administrative charges and service charges, inclusive of goods and service tax (GST). Jskare reserves the right to adjust the prices based on market price fluctuation and amend the availability of its products without notice.
Payment
Purchases can be made in your preferred payment method such as bank transfer, debit or credit card and digital wallet. Jskare shall not be liable for any fraud.
In a case you are entitled for your refund, the receipt of the refund will depend on the period of time your financial institution takes to finalise the refund. Jskare shall not be liable with respect to any loss, damage, cost or expense that you or any person may incur as a result of any delay in your financial institution processing the said refund.
Delivery of Products
International shipments may need to go through Customs from the country of departure to the country of destination which could take approximately 7 to 14 business days. Below is a brief shipping process of your order online:
1 Your order will be processed in between 2 to 24 hours. A tracking number will be provided but no update will be shown until your parcel is handed to the local courier.
2 Parcel will be picked up by overseas courier.
3 Parcel will be going through export customs clearance and handed to an international carrier for departure.
4 Once parcels are customs cleared, a transport operator will collect the parcel and deliver it to your final destination. Tracking may only be updated after it is handed to the local courier.
The customer must read and understand how the delivery works and accept before placing their order.
Delivery Time
The delivery of the products is usually within 7 to 14 business days and depends on the completion of the order and depends on the availability of the products, the place of shipment of the products and the confirmation of the customer details. In exceptional cases, the delivery time can be extended, provided that the Customer has been previously informed.
The order may be delayed for the following reasons:
Product Availability: Product has been discontinued or is in short supply and is not available.
Logistical Challenges: Issues with transportation, such as vehicle breakdowns or limited availability.
Route Length: Longer routes naturally take more time, especially for international shipping.
Weather Conditions: Adverse weather can delay transportation.
Wrong Information: Customer’s details entered are incorrect.
Exceptions apply
We cannot guarantee delivery times and during sale periods and over Public Holidays delivery will take longer than usual.
Shipping Costs
The products are delivered by courier companies, to which Jskare forwards the users’ personal information, such as name, shipping address, contact information and phone number, so that the delivery and execution of the orders becomes possible.
The costs of transport and management of the shipment are borne by the Customer and are paid to the courier company through internet banking or by debiting the credit card /debit card, digital wallet at checkout.
For purchases of RM130 and above, the Customer will not be charged shipping costs. Jskare reserves the right to change the above minimum amount and the conditions for free shipping.
Customer Rights
Right of Withdrawal
The Customer has the right to withdraw without giving a specific reason at any time under a condition that the ordered items are not yet dispatched from overseas.
In case of exercising the right of withdrawal, a refund will be issued to the payment method used to pay for the order. If the price has been charged to the Customer’s credit card, the exercise of the right of withdrawal also results in the termination of the relevant tripartite contract between the Customer – supplier and the bank, without payment of compensation.
There will be strictly no cancellation or return under the reason: Change of Mind.
Right of Substitution
The Customer has the right to request a product replacement, if what was delivered to him was defective, damaged, altered or does not correspond to the product he ordered. In this case, it is necessary to contact the Company immediately at the phone number located in the “Contact” section of the Website or email us at jskare889@gmail.com, so that the replacement or refund can follow. In case of receipt of a defective, altered or damaged product, it is also necessary to send photographic material showing the defect or damage to the product as well as the package received by the carrier. A necessary condition is also that the product is in the condition in which it was received, that it has not been used, and that the Customer has the sales document. In any case, the maximum return period for submitting a replacement request cannot be extended beyond fifteen (15) calendar days from the date of receipt. The shipment of the new product will take place within a time period equal to the shipment time of the original one. In the event of a refund, the refund rules apply in the event of withdrawal.
In any case of product return, the customer is obliged to deliver intact and in excellent condition all the documents that accompanied the product.
Filing Complaints and Dispute Resolution
For any case where the Customer was not satisfied with the fulfillment of the order or for any other reason, he has the right, within fifteen (15) days from the presentation of the problem, to submit a complaint to the Company by e-mailing us at jskare889@gmail.com.
The Customer’s complaint will be examined immediately and the answer will be sent to him by the company at the latest within ten (10) days of its receipt. When examining the complaint, the company reserves the right to contact the Customer to clarify the circumstances that created the reported problem. In this case, the Customer should facilitate by providing the relevant information, for the settlement of the issue.
For any case concerning the operation of the online store, the Customer, accepting the present terms of use, has an obligation to follow the procedure for submitting a complaint before choosing to initiate legal procedures.
These Terms & Conditions describe the relationship between you and us, they do not create legal rights for other persons, even if they may benefit from such relationship.
Warranty
Jskare does not provide any guarantee neither for the quality nor for the suitability of the products sold for any specific purpose, nor does it guarantee the safety and protection of the users of these products. Such guarantees are provided, if provided, only by the manufacturers and the customer must be informed about this from the product packaging.
We do not provide any warranty or guarantee as to the accuracy, timeliness, completeness or suitability of the information and materials found in this Website. We expressly exclude liability for any such inaccuracies or errors permitted by law.
Gifts
Jskare may offer gifts (accessories or devices or products in a special size or packaging, free of charge or at a special offer price) in the context of a commercial or advertising campaign.
Jskare does not provide any guarantee for the gifts it offers and reserves the right to replace the gift unilaterally, without warning or prior information or consent of the customer, with another gift in case of exhaustion of the gift before or after the registration of the order by the customer.
The customer accepts that he has no claim against Jskare due to the replacement of the gift.
